General Information
These Terms of Service govern the use of the MyMiniScore service available at myminiscore.com ("Service"). The service provider is Sebastian Flejszman, trading as Web Technologies Sebastian Flejszman, ul. kard. Stefana Wyszynskiego 8/95, 99-300 Kutno, Poland, NIP 7752511215, REGON 101841388, registered in the Polish Central Registration and Information on Business (CEIDG), email info@webtechnologies.pl. By using the Service, you agree to comply with these Terms.
Definitions
Service - MyMiniScore internet platform enabling AI analysis of miniature photos
User - natural or legal person using the Service
Content - photos, texts and other materials uploaded by Users
AI Analysis - automatic assessment of miniature painting quality using artificial intelligence
Acceptance of Terms
Beginning to use the Service means acceptance of these Terms. If you do not agree with these provisions, do not use the Service.
The Service is intended for persons over 16 years of age. Younger persons may use the Service only with the consent of parents or legal guardians.
Service Usage Rules
When using our Service, you agree to:
- Use the Service in accordance with these Terms and applicable law
- Provide accurate information and upload only your own content
- Respect intellectual property rights and privacy of others
- Not abuse the system or attempt to damage or disrupt the Service
- Maintain the security of your account credentials (if applicable)
- Provide accurate and up-to-date information when requested
Prohibited Uses
You may not use our Service for:
- Uploading illegal, harmful, or inappropriate content
- Violating intellectual property rights of third parties
- Spam, harassment, or malicious activities
- Attempting to reverse engineer or copy our AI algorithms
- Using automated systems to access the Service without permission
Content Policy
Content uploaded to our Service must comply with the following requirements:
- Content must be appropriate and not violate community standards
- You must own rights to uploaded photos or have permission to use them
- Photos should be clear and suitable for AI analysis
We reserve the right to remove content that violates these policies.
Public profile, work and commissions
The Service lets you publish your work and take on painting commissions. The following rules apply:
- Your painter profile and individual pieces of work are private by default. They become public only when you enable them and can be switched off at any time
- By publishing a piece of work you confirm that you hold the rights to it and that the photo shows a model you painted yourself
- A commission is agreed directly between the painter and the client. The provider is not a party to it, does not process payments, takes no commission and is not responsible for delivery or for settlement between the parties
- A painter accepting commissions is solely responsible for their own tax settlements and for consumer-law obligations towards their clients
- Messages are for agreeing commission terms. Using them for unsolicited advertising, harassment or to work around a block set by another user is prohibited
Reporting content and moderation decisions
Anyone can report content they believe is unlawful or in breach of these Terms. Reports are accepted by email at info@webtechnologies.pl - that address is also the point of contact for users and authorities. In addition, inside a conversation you can report or block the other user directly in the Service.
- A report should include the address of the content, the reason for reporting and a way to contact you
- We review reports without undue delay and inform the reporter of the outcome
- If content is removed or restricted, its author is told about the decision, given the reasons for it and informed how to appeal
- A decision can be appealed within 14 days by writing to the same address. Appeals are reviewed by a person, not an automated system
Complaints
Complaints about the Service can be sent to info@webtechnologies.pl. A complaint should describe the problem and include contact details. We respond within 14 days of receipt; failure to respond within that period counts as accepting the complaint.
Service Availability
We strive to provide reliable service, but cannot guarantee:
- Continuous availability without interruptions
- 100% accuracy of AI analysis results
- Availability of all features at all times
We may perform maintenance that temporarily affects service availability.
Right of Withdrawal
The core features of the Service are free of charge. Should paid services be introduced, consumers have the right to withdraw from a distance contract within 14 days without giving a reason. Starting to use a digital service or content before that period ends - with the consumer's express consent and after being informed of the loss of the withdrawal right - results in the loss of that right under applicable consumer law.
Liability Limitations
MyMiniScore provides AI analysis for educational and entertainment purposes. We are not liable for:
- Accuracy or completeness of analysis results
- Service interruptions or technical issues
- Decisions made based on our analysis results
For paid services, the operator's liability is limited to the fees paid by the User in the 12 months preceding the event. This limitation does not apply to damage caused intentionally, nor to liability that cannot be excluded or limited under mandatory law, in particular consumer rights.
Indemnification
You agree to indemnify and hold MyMiniScore harmless from claims arising from your use of the Service or violation of these Terms.
Intellectual Property
Intellectual property rights are governed as follows:
- You retain ownership of photos you upload
- You may request deletion of your content at any time
MyMiniScore retains all rights to the Service, AI algorithms, and analysis technology.
Modifications to Terms
We may update these Terms periodically. Continued use after changes constitutes acceptance of new Terms.
Termination
We reserve the right to suspend or terminate your access for violation of these Terms.
Upon termination, your right to use the Service ceases immediately.
Governing Law
These Terms are governed by Polish law, without prejudice to the mandatory consumer-protection rules of the country where the consumer habitually resides. Disputes with Users who are not consumers are subject to the court having jurisdiction over the operator's registered seat; for consumers, jurisdiction is determined by generally applicable law.
Dispute Resolution
We encourage resolving disputes amicably - contact us at info@webtechnologies.pl if needed. Consumers may also use out-of-court complaint and redress mechanisms, including the EU Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
Severability
If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.
